Hobbs Administration Declares Support For Birthright Citizenship

Estimated Reading Time: 2 minutesEditor’s Note: The Fourteenth Amendment, Section 1: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” There is nothing “partisan” in the Amendment itself, but clearly, the interpretation has become a matter between the political parties. The key is the clause “and subject to the jurisdiction thereof.” What does jurisdiction mean? Are tourists subject to the jurisdiction of the US government? Do they pay taxes and enroll in the draft? Do they lose their citizenship in their mother country? No, they don’t, so if a tourist gives birth on US soil, is the baby a citizen? What about an illegal alien? That is the question that must be decided by the courts. Hobbs can “declare” anything she wants, but it will be decided in the courts. The second question is, why should we want to make citizens of those born by illegals? Or, “tourist babies”, frequently born of Chinese mothers who come here specifically to give birth and then return home?  How can one be under the “jurisdiction” of the US government when someone enters illegally and whose existence in the country is not even known? Democrats do not believe in borders and the nation-state and think we’re all citizens of the world. They want to import voters because they can’t get enough Americans to vote for them. We differ.

The Hobbs administration issued “declarations” affirming its support for birthright citizenship following an executive order from President Donald Trump eyeing an end to it.

The declarations from the Arizona Department of Homeland Security and the Arizona Health Care Cost Containment System came shortly after Attorney General Kris Mayes joined a lawsuit with Washington, Oregon and Illinois suing the president over the action that was done with the intention of cracking down on people in the country illegally having children who will automatically become citizens.

The Center Square reported that Trump considers birthright citizenship “ridiculous,” whereas proponents are arguing that it is covered under the 14th Amendment.

“Ending birthright citizenship is unconstitutional and un-American. We should protect what makes our country exceptional, not tear it down,” Hobbs said in a statement.

“And it would cause chaos in our state government, making it harder for our state to deliver the critical services that Arizonans rely on and burden Arizona taxpayers with increased costs. We should take common sense steps to secure our border and protect our communities, but ending birthright citizenship will not do that. I urge the president to reconsider a policy that attacks our country’s ideals and does not secure our border.”

According to a news release from the governor’s office, the declarations are meant to document the state’s stance in legal actions on the issue.

“A newborn’s completed birth certificate does not indicate whether the parents have an SSN,” the declaration from Chief Reporting Office and Assistant State Registrar for the state DHS states. “The only information on the parents is the mother’s legal name, the father’s full name (if provided), their places and dates of birth, and address. Currently, it is not possible to determine a foreign-born parent’s immigration status from their child’s birth certificate.”

Once Trump took office on Monday, he initiated a sweeping crackdown on immigration and border policies following the high influx of migrants into the United States during the Biden administration. Besides the order on birthright citizenship, mass deportations for those in the country illegally are also expected.
